CLIENT ARRESTED FOR FAILURE TO REGISTER AS A SEX OFFENDER

ORIGINALLY CHARGED WITH “INDECENT ASSAULT AND BATTERY”

Please note-this is an example of the disposition of a recent sex offense case. It is by no means a guaranty of any particular result in any other case.

BASIC FACTS: An adult defendant was convicted in Massachusetts of “indecent assault and battery” on a person under the age of 14. The Massachusetts conviction was 15 years old.   At the time of the conviction, there was no requirement to register as a “sex offender”.  The defendant was never notified by Massachusetts authorities of the sex offender registration requirement.

The defendant then moved to New Hampshire.  15 years later, New Hampshire authorities arrested the defendant for failure to register as a sex offender.  The police alleged that the defendant was required to register as a sex offender under RSA 651B:4.

PRE-TRIAL MOTION STRATEGY: Attorney Stevens filed a motion to dismiss this case. He argued that there was no requirement that the defendant register at all, and that the defendant’s failure to register therefore did not constitute a crime.

HEARING: The Court granted Attorney Stevens motion; the charge was dismissed.

CASE RESULT: The case was dismissed.  The defendant was not convicted.  DISMISSED!!! NO CONVICTION; NO SEX OFFENDER REGISTRY!!!
