Keene Pumpkin Fest Arrest Ends in Not Guilty Verdict

Not Guilty Verdict after Trial July 28, 2014
Please note-this is an example of the result of a recent New Hampshire criminal case. It is by no means a guarantee of any particular result in any other case.
FACTS OF THE CASE: In this case, the Keene Police charged a citizen with the “minor in possession of alcohol, second offense”, which is a violation of New Hampshire Law RSA 179:10. During the annual #Keene “PumpinFest”, a Keene police officer in a cruiser saw a young man walking down a street in Keene, allegedly with a can of beer in his hand. As the cruiser approached the citizen, the citizen allegedly tossed the empty beer on the ground. The officer stopped the young man, checked his driver’s license. The officer determined that the citizen was 20 years old at the time, and that he had a prior conviction of “minor in possession of alcohol” or “unlawful intoxication by a minor” under RSA 179:10. A conviction on this charge could have led to a license suspension for between 6 months to two years, even though the citizen was not driving a car when he was arrested!
The citizen hired Salem, NH Attorney Mark Stevens to represent him in court. Attorney Stevens requested a trial date.
TRIAL: At trial, the state presented the testimony of the officer who charged the citizen, as well as the menacing empty can of beer as evidence. When the state was done, this citizen told his side of the story as well. As is so often the case, the two sides did not agree. After considering all the testimony and exhibits, the Court found this citizen “not guilty” of this offense.
RESULT: This citizen was found “Not Guilty” after trial.
