New Hampshire DWI Case Example: A police officer watched a driver proceed through a red arrow without stopping.  The officer decided to follow this citizen.  The officer then saw the driver drive through another red arrow at the next intersection.  The officer turned on his blue lights and stopped this citizen. 

The officer reported that the driver’s eyes were bloodshot and glassy, and that he smelled an odor of alcohol coming from inside the car.  You should know that these stock observations are included in every DWI arrest report.  He noticed that the driver had a Massachusetts “Cinderella license” and that she was driving outside the 12 hours authorized under this type of work license.  He asked the driver to step out of the vehicle for “field sobriety tests”, a series of roadside aerobics designed to incriminate the driver.

The officer reported an unremarkable medley of “clues of alcohol impairment” on these field sobriety tests and subsequently arrested the driver for driving while intoxicated, second offense, and operating after an OUI revocation or suspension under the New Hampshire DWI laws.  Both of these charges carry mandatory jail time if convicted.  At the police station, this citizen exercised her right to decline the arresting officer’s invitation to submit to a blood test.  The citizen advised the officer that she would not take the blood test because it would reveal a controlled drug and marijuana. 

This driver hired Salem, New Hampshire DWI defense lawyer Mark Stevens to defend her at her trial.  Attorney Stevens’ motion to dismiss all these charges was granted in the District Court.  Because he also obtained a dismissal of the administrative license suspension for refusing the blood test, this citizen did not lose her right to drive for a single day, despite facing a total of 5 years of license loss if she lost in New Hampshire and an 8 year license revocation in Massachusetts.

Note-this is one example of a recent New Hampshire DUI-DWI case victory. It is by no means a guarantee of any particular result in any other case.
