New Hampshire DWI Case Example: A police officer noted what he described as a “wide radius turn” by a driver.  The officer decided to follow this citizen.  The officer noted that the driver “nearly hit a mailbox”, then came to a stop in the middle of the street.  The officer activated his blue emergency lights and stopped the driver.  When the driver pulled over she allegedly almost hit another alleged mailbox.

The officer reported that the driver’s eyes were bloodshot and glassy, and that he smelled a strong odor of alcohol coming from inside the vehicle.  He asked the driver to step out of the vehicle for “field sobriety tests”, a series of circus-monkey tricks designed to incriminate the driver.

The officer reported an unremarkable potpourri of “clues of impairment on these field sobriety tests and subsequently arrested the driver for driving while intoxicated under the New Hampshire DWI laws.  At the police station, this citizen exercised her right to decline the arresting officer’s invitation to blow into the breath testing hose. 

This driver hired Salem, New Hampshire DWI defense lawyer Mark Stevens to defend her at her trial.  Attorney Stevens cross-examined the officer and exposed some weaknesses in the state’s case against this driver.  For example, the mail boxes she “almost hit” were actually flush with the road.    At the end of the trial, the verdict was “not guilty” of DUI.

Note-this is one example of a recent New Hampshire DUI-DWI case victory. It is by no means a guarantee of any particular result in any other case.
