New Hampshire DWI Case Example: A citizen was stopped for speeding in New Hampshire.  She was driving 49 miles per hour in a 35 mile per hour zone.  The officer who made the speeding stop asked the driver questions about drinking; she had consumed one glass of wine.  The officer asked the driver to perform DWI “field sobriety tests”: the “horizontal gaze nystagmus” test (also known as the “HGN” test or the “magic pen test”), the walk and turn test and the “one leg stand” test.  The alleged results, predictably, were failures of the field sobriety tests.  The citizen exercised her right to decline the arresting officer’s invitation to blow into the breath testing hose at the police station. 

This driver hired Salem, New Hampshire DUI-DWI defense lawyer Mark Stevens to defend her at trial.  Attorney Stevens cross-examined the officer and exposed some weaknesses in the state’s case against this driver.  At the end of the trial, the verdict was “not guilty” of DUI.
