New Hampshire DWI Case Example: A driver was stopped because he drove past a parked police cruiser with no license plates visible.  The driver had license plates, but they were on the seat inside the car next to him.  The officer activated his blue lights and stopped the driver.  When the officer approached and looked inside the truck he saw a 24 ounce can of beer in the truck’s cup holder.  The beer can was opened.  After handing his license to the officer this driver was asked to step out of his car and perform the DUI sidewalk acrobatics called “field sobriety tests”.  The officer asked the driver what he had to drink; the driver told him he was having his first beer on his way home from the beer store. 

The driver citizen was run through the 3-part ritual known as “field sobriety testing”: a “follow-the-pen” test, a “walk-and-turn test” and a “one leg stand test”.  Despite doing fairly well on these “tests”, the trooper arrested the driver any way for DWI.  This driver declined the trooper’s invitation to incriminate himself after his arrest with any breath testing.  The driver hired Salem, New Hampshire DWI lawyer Mark Stevens to defend him at trial.  After a trial in the District Court, this citizen was found not guilty of first-offense DWI.

Note-this is one example of a recent New Hampshire DUI-DWI case victory. It is by no means a guarantee of any particular result in any other case.
