New Hampshire DWI Case Example: A citizen was arrested for DWI in 2010.  Because she had been arrested and convicted three years earlier for another New Hampshire DWI charge, she was charged in her 2010 case with “DWI-Second Offense”.  In her first offense, she pleaded “no contest” and was convicted. She did not have a lawyer for that case.

For her 2010 DWI case, she hired New Hampshire DWI lawyer Mark Stevens to defend her.  Prior to her trial, Attorney Stevens filed a motion to keep the evidence of her first offense out of evidence at trial.  Two hearings were held on that motion, at which Attorney Stevens argued that the citizen’s Constitutional rights were violated based upon defects in her plea colloquy in the first DWI case.

After hearing arguments on Attorney Stevens’ motion, the District Court vacated the prior offense.  Winning this motion kept this citizen out of a mandatory jail sentence, and converted her 2010 case from a DWI-second offense case to a DWI-first offense case.

Note-this is one example of a recent New Hampshire DWI case victory. It is by no means a guarantee of any particular result in any other case.

RESULT:    Motion to vacate a prior New Hampshire DWI conviction granted!
