CASE EXAMPLE: A police
officer stopped a car for speeding. The
officer turned on his blue lights and the citizen stopped his car. The officer asked the citizen for his license
and registration. The officer claimed
that the citizen’s movements seemed slow.
When he asked the driver to get out of the car, the officer said that
the driver “leaned on the door for balance” and was “unsteady in his
gait”.
Once at the rear of the car, the citizen performed
the standard “roadside gymnastics” known as “field sobriety tests”. Predictably, the officer concluded that the
citizen was intoxicated. After his
arrest, the citizen refused to blow into the breath testing hose at the police
station. The police then sought a 180
day suspension of this citizen’s driving rights and filed a criminal complaint
for DWI against him in Court.
