New Hampshire DWI Laws: The police in this case came upon a man who appeared to be urinating several feet away from a car on a secluded road.  The man’s back was to the cruiser.  As the cruiser approached and stopped the man walked away from both the cruiser and the other car.  The officer ordered him to stop.  The officer described the man as being “in a stance consistent with some one who was urinating but with his back to (the officer)”.  The vehicle was lawfully parked at the time.  The officer activated his blue lights and ordered the citizen to stop what he was doing and provide a driver’s license.  After the usual series of roadside acrobatics, and the usual alleged mistakes by the citizen while performing them, the officer arrested him and charged him with DWI.  This citizen hired DWI defense lawyer Mark Stevens to defend him.

        On the citizen’s trial date, Attorney Stevens moved to dismiss the DWI charge against this citizen, and the District Court granted the motion to dismiss.
