DWI CASE
EXAMPLE: A citizen was stopped on
a highway for driving 93 miles per hour and crossing the white fog line that
marks the left hand boundary of the passing lane. The police officer activated his blue lights
and the citizen pulled over. The officer
directed the citizen through a series of roadside gymnastics called ?field
sobriety tests?: the ?pen test?, the
?nine-step-walk-and-turn-test, and the standing on one leg test. Under the police scoring system, the citizen
scored 15 clues of impairment out of a possible total of 18. On the pen test he scored 6 out of a possible
6 impairment clues: under police scoring he failed every possible aspect of the
pen test.
On the ?walk and turn test?,
the driver ?scored? a 6 out of 8 possible ?clues of impairment?. If this were a test in school, he would have
got an ?F? with a grade of 25%. On the
?one leg stand test, the driver dropped his foot 7 times during 30 seconds and
got 3 out of a possible 4 ?points? (another ?F? on the police scorecard). All told, this citizen allegedly got 15 tasks
wrong out of a possible 18; a miserable F- grade of 17% correct across the
three ?field sobriety tests?. He was
then arrested for DWI. He did not take a
breath test. He hired Salem, New
