DWI CASE EXAMPLE: A citizen was arrested for DWI.  He did not take a breath test after his arrest.  He went to his arraignment without a lawyer and spoke to a prosecutor.  The prosecutor gave him a form and said that if the citizen pleaded guilty to the DWI as charged, the prosecutor would “recommend the minimums” to the Court.  Believing the minimum penalties, as bad as they were, were the best he could do, the citizen pleaded guilty to DWI.  He lost his license for 6 months, paid a hefty fine, was forced to attend a complete a program, and obtain an SR-22 proof of financial responsibility certificate and maintain the SR-22 for three years.

        The citizen was not aware that he had other options, such as fighting the case and going to trial.  He also did not know that his decision to plead guilty could come back to bite him for years.   He was later charged with a couple of DWI charges in another state and his license was revoked for many years.  Concerned that he did not know the effects and consequences of his guilty plea and conviction in New Hampshire, the citizen hired Salem, New Hampshire criminal defense Attorney Mark Stevens to attempt to vacate his old New Hampshire DWI conviction.

Note-this is one example of a recent New Hampshire DWI case victory. It is by no means a guarantee of any particular result in any other case.

STRATEGY:         Attorney Stevens filed a motion to vacate the old DWI conviction based on constitutional infirmities with the old plea and sentence. 

RESULT:    The motion to vacate the prior DWI conviction was granted after a hearing.  Subsequent to the order to vacate the conviction, Attorney Stevens successfully moved to DISMISS the DWI complaint.  In the end the conviction was vacated, then the DWI charge was dismissed!!!
