DWI CASE
EXAMPLE: After a costume party in
late October, a driver became lost while navigating her way home at around 2
a.m. in the morning. A police officer
began to follow her for no reason at all.
After he followed her for a while he saw her “weave within her lane of
travel”, then “cross the yellow line” three times, the hallmarks of most
traffic stops that lead to DWI arrests.
The police officer activated
his blue emergency lights and the citizen stopped her car by pulling over to
the right. The weather was rainy and the
roads were soaking wet. The officer
approached the driver’s side window and smelled an odor of alcohol coming from
inside the car. The officer interrogated
the citizen about drinking; she told the officer that she had had a few drinks
at a costume party earlier in the night.
The driver was dressed in a cat costume and a passenger had become ill
in the front passenger seat.
The
officer ordered this citizen to get out of her car. The officer then ordered her to perform “field
sobriety tests”, the sidewalk acrobatics that immediately precede an arrest for
DWI. Once she got out of his car, the
police officer reported that he observed the usual medley of observations that
officers report in a DWI chronicle: red glassy eyes, “obvious odor of alcohol
coming from her person”, and other stock observations. The roadside Olympics in this case were the
three standard circus-monkey style calisthenics that drivers are asked to
perform before they are arrested for DWI.
After the citizen allegedly “failed two of the three tricks, she was
arrested for DWI, otherwise known as “driving while intoxicated”.
The
officer then asked the driver if she would take a breath test and she exercised
her right to refuse to blow into the black rubber breath test hose at the
police station. This citizen hired Salem, New Hampshire
criminal defense Attorney Mark Stevens to fight her DWI charge.
Note-this is one example of a recent New Hampshire
DWI case victory. It is by no means a guarantee of any particular result in any
other case.
TRIAL:
At trial, the state presented the testimony of the officer, after which
Attorney Stevens cross-examined him about the many actions she did that were
consistent with sobriety. After the
trial, this driver was found not guilty of driving while intoxicated.
RESULT: Not
Guilty!!!
