DWI CASE
EXAMPLE After a busy day at the
NASCAR races, thousands of cars were pouring onto the highways. A police officer received a call from a
dispatcher that other officers had observed a car “driving erratically”. The officer spotted the car identified by
dispatch and began to follow it. The
officer saw the car “weave within its lane” and “cross the fog line”. The officer activated his blue emergency
lights but the car did not stop immediately.
The car drove for about one quarter to one half mile before
stopping. The officer approached the
driver’s side window and smelled an odor of alcohol coming from inside the
car. The officer interrogated the driver
about drinking; the driver told the officer he had had two beers at the race
earlier. He saw the driver and four
other occupants in the car, including two women in the backseat that were
yelling that they were lost.
The officer ordered this citizen
to get out of his car. Once he got out
of his car, the police officer began to question him again about drinking. The officer noticed that the driver had
“dilated pupils”, “red bloodshot eyes” and a “slight slur” when he spoke. Another police officer arrived and asked the
citizen if he would submit to a battery of “field sobriety tests”. These are the circus-monkey style
calisthenics that drivers are asked to perform before they are arrested for
DWI. After initially agreeing to perform
the sidewalk gymnastics, this citizen refused to perform these “tests”. The police then arrested him and charged him
with “driving while intoxicated”.
The
officer then asked the driver if he would take a breath test and he refused to
submit to any breath testing. This
citizen did not give the police much evidence against himself. This citizen hired Salem, New Hampshire
criminal defense Attorney Mark Stevens to fight his DWI charge.
Note-this is one example of a recent New Hampshire
DWI case victory. It is by no means a guarantee of any particular result in any
other case.
TRIAL:
At trial, the state presented the testimony of the two arresting officers,
after which Attorney Stevens cross-examined them about this citizen’s
cooperative, polite demeanor and the many actions he did that were consistent
with sobriety. After the trial, this
driver was found not guilty of driving while intoxicated.
RESULT: Not
Guilty!!!
