DWI CASE
EXAMPLE In this case, a police
officer saw a car in the breakdown lane and stopped his cruiser to check on it.
When he approached the driver’s side door he saw the driver hunched over the
center console and a small pile of powder next to him. The driver blew the
powder off the console and put some of it in his mouth. The officer asked the
driver why he had stopped in the breakdown lane and the driver explained that
he had just stopped to make sure his registration had not expired. The officer
asked if he had had anything to drink. The driver chose to answer the question
and said he had a few beers earlier.
The officer asked the driver if he took any medications and the driver
chose to answer that question too. The driver explained that he takes clones-spam. The officer asked the driver if he was supposed
to mix alcohol and clonazepam to which the driver
responded that he didn’t know. The
officer then ordered the driver out of the car for a series of circus
monkey-tricks that the police call “field sobriety tests’. The circus monkey
tricks in this case were the usual three culprits of DWI arrests: the waving
the pen test, the walk on the white line test and the stand on one leg test.
The drive chose to play a role in this three part circus act.
Even though the driver’s “performance” on these sidewalk gymnastics was
good, the officer arrested him anyway and charged him with driving under the
influence of alcohol and drugs. The
officer then asked the driver if he would take a breath or blood tests and the
driver refused to submit to any breath testing or blood testing.
This citizen hired Salem, New Hampshire criminal defense Attorney Mark
Stevens to fight his charge.
Note-this is one example of a recent New Hampshire
DWI case victory. It is by no means a guarantee of any particular result in any
other case.
TRIAL:
At trial, the state presented the testimony of the arresting officer, after
which Attorney Stevens cross-examined him about the many examples of good
performance on the circus-monkey tricks and the driver’s cooperation,
politeness and demeanor. After the
trial, this driver was found not guilty of driving while intoxicated.
RESULT: Not
Guilty!!!
