Driver charged with DWI after single
vehicle accident…
DWI CASE EXAMPLE: A truck went off the road after the driver didn’t successfully negotiate
a difficult turn. When the police
arrived the driver and a passenger were at the scene. The truck’s airbags had deployed. The officers smelled an odor of alcohol and
began to interrogate one of the people about drinking. The man admitted to drinking four beers
throughout the day.
When the officers
asked the man to perform the sidewalk circus tricks known as “field sobriety
tests”, the man wisely declined. The
police arrested him and charged him with DWI.
At the police station the man elected not to provide any evidence
against himself and refused breath testing, blood testing, and rejected a
second offer to perform the sidewalk acrobatics inside the police station.
After the arrest, the driver hired Attorney
Stevens to fight the DWI charges.

RESULT: The case went
to trial in the district court. The
officer testified about the driver’s “red eyes”, “slurred speech”, and
“unsteadiness on his feet”, the hallmarks of every DWI case. After trial, Attorney Stevens’ client was found
not guilty on November 20, 2008!!!
