NOT GUILTY DWI CASE EXAMPLE: NOVEMBER 3, 2008

Driver charged with DWI after speeding…

DWI CASE EXAMPLE: A police officer clocked a driver on radar travelling over the speed limit.  The officer activated his blue lights but the driver did not stop right away.  Eventually the driver stopped for the officer.  Because he failed to stop when signaled to do so, the officer charged the driver with aggravated DWI and disobeying a police officer, as well as DWI and speeding.  The driver had difficulty producing his license and could not find his registration.  The officer smelled an odor of alcohol and interrogated the driver about drinking.  The driver did not perform the sidewalk ritual known as “field sobriety tests” prior to his arrest.  The driver elected not to provide any evidence against him at the station; he refused to blow into the black rubber breath testing hose.  After the arrest, the driver hired Attorney Stevens to fight the DWI charges.
