BASIC FACTS: The defendant was arrested for DWI.  When the police ran his record they found a 5 year old prior DWI conviction on his record.  The defendant had pleaded guilty 5 years earlier to a DWI charge without a lawyer, and without understanding that the conviction would still haunt him five years later.  He hired Attorney Stevens to move to vacate his old conviction and eliminate the risk if jail time on his recent DWI charge.

DEFENSE:     Attorney Stevens discovered that the defendant was not properly advised that his old 2001 conviction could be used against him in future DWI proceedings and that his constitutional rights had been violated during the old DWI plea.  He filed a motion to vacate the 2001 conviction, which the Court granted.  This had the effect of changing the defendant’s open 2006 case into a DWI first offense and eliminated any chance the defendant would serve any jail time!  

RESULT:       CONVICTION VACATED!!!
