DWI CASE EXAMPLE: NOT GUILTY VERDICT SEPTEMBER 16, 2008

The New Hampshire DWI laws and penalties are tough.  Here is an example of a recent case victory-a NOT GUILTY VERDICT after a trial in a New Hampshire DWI case:

DRIVER STOPPED FOR “WEAVING”, “SWERVING” AND “CROSSING THE LANE MARKERS”, HE WAS ARRESTED FOR DWI.

THIS DRIVER EXERCISED HIS RIGHT TO REFUSE TO BLOW INTO THE OLD RUBBER BREATH TEST HOSE AT THE POLICE STATION

DWI CASE EXAMPLE: A police officer stopped a driver for allegedly “weaving and swerving” and for “crossing the lane markers”.  The officer turned on his blue lights and the cooperative driver brought his car to a stop.  The driver gave his license and registration to the officer.  The driver remained polite and cooperative with the officer throughout this frightening encounter.   

When the officer smelled an “odor of alcohol” coming from the driver’s car, and interrogating the driver about alcohol consumption, the officer ordered this citizen out of his car for a series of roadside acrobatics known as “field sobriety tests”.  This ritual has a predictable ending: once you are asked out of the car, you are probably not getting back into the car.  IT IS IMPORTANT TO NOTE THAT YOU DO NOT HAVE TO DO THESE ROADSIDE ACROBATICS.  These “field sobriety tests” have a “scoring system” that was cobbled together by people who got a big government grant to come up with a scoring system in the mid-1970’s.  There are 18 possible things a citizen can do to “fail” these tests.  This citizen allegedly got ALL 18 WRONG!  Wow! Sounds really drunk, right?

The officer arrested this citizen and charmed him with “driving while intoxicated” (“DWI”), a class B misdemeanor in New Hampshire.  The citizen refused to blow into the old rubber breath hose at the police station.

Please note-this is an example of the disposition of a recent New Hampshire DWI case. It is by no means a guarantee of any particular result in any other case.

The driver hired Attorney Stevens to fight his DWI charge.  Attorney Stevens obtained a copy of a DVD of this citizen’s booking, which was conducted about 6 minutes after his allegedly miserably drunken “field sobriety tests”.  Attorney Stevens played this DVD at the trial.  On the 18 minute DVD, this citizen was perfectly sober; not one bit drunk.  If you watched this DVD you would wonder why this man was ever arrested.  He talked normally, answered questions, had perfect fine motor skills, and spoke perfectly clearly.  There was absolutely no doubt that this man was sober.  Fortunately, he was one of the few people in New Hampshire DWI cases that are actually videotaped, who have the opportunity to show the real, uncontestable truth at trial that they are actually innocent.  He was found “not guilty” after trial.

RESULT:      After the trial in this case, this innocent driver was found NOT GUILTY!!!
