LICENSE SUSPENSION FOR “REFUSAL” TO SUBMIT TO BREATH TEST

DWI CASE EXAMPLE: POLICE STOPPED A DRIVER FOR SPEEDING AND “CROSSING A WHITE LINE”.  THE OFFICER STOPPED THE DRIVER, RAN HER THROUGH THE USUAL GAUNTLET OF “FIELD SOBRIETY TESTING” (THE ROADSIDE DWI GYMNASTICS) AND ARRESTED HER FOR DRIVING WHILE INTOXICATED/ “DWI”.  ONCE AT THE STATION, THE OFFICER QUICKLY READ THROUGH AN ADMINISTRATIVE LICENSE SUSPENSION RIGHTS FORM AND ASKED THE DRIVER TO SIGN THAT HE HAD READ HER THOSE RIGHTS.  SHE SIGNED ACKNOWLEDGING THAT HE HAD READ HER THE RIGHTS.  BECAUSE THE DRIVER ASKED IF SHE COULD READ THE FORM HERSELF, AND BECAUSE SHE DID NOT IMMEDIATELY SNAP TO THE OFFICER’S DEMAND TO BLOW INTO THE BREATH TESTING HOSE, HE “DEEMED HER TO BE A REFUSAL”.  SHE TRIED TO BLOW INTO THE BREATH HOSE, BUT THE OFFICER WOULDN’T LET HER.  SHE HIRED ATTORNEY MARK STEVENS, http://www.ByeByeDWI.com TO APPEAL HER 6 MONTH ADMINISTRATIVE LICENSE SUSPENSION BECAUSE SHE NEVER ACTUALLY REFUSED TO BLOW INTO THE BLACK RUBBER BREATH HOSE.

HEARING RESULT:          After an hour long hearing the Hearings Examiner rescinded (threw out) the 6 month suspension that the police tried to get because the driver dared to ask some questions.. 

RESULT:      ATTORNEY STEVENS’ MOTION TO DISMISS THIS 6 MONTH SUSPENSION WAS GRANTED!!!
