BASIC FACTS: Police respond to a call regarding a domestic disturbance. Defendant is standing driveway when the police arrive; his wife is inside the house. One officer interviews wife; another officer interviews husband. Wife claims husband hit her, choked her, pulled her hair and kicked her, and that he then destroyed the phone so she could not call 911. The man shows signs of recent facial injuries. No evidence of any injuries to the woman, but police confirm that the phone has been broken. The man was charged with three counts of domestic assault and one count of obstructing the report of a crime, all Class A misdemeanors. Each charge carries a potential maximum penalty of one year in jail and a $2000 fine.
DEFENSE: Actual innocence.
TRIAL RESULT: The state presented the testimony of the two police officers that responded to the scene, as well as the woman who claimed the defendant assaulted her. After trial, the defendant was found NOT GUILTY of all four charges. He left the courthouse a free man.
