BASIC FACTS: Police respond to a call regarding a domestic disturbance. Woman is heard screaming on phone. Upon arrival, police seek the consent of a drunken man to enter the home. The man shows signs of recent facial injuries. Various indicators of a disturbance are seen, items broken, pictures on the floor, phone off the hook, etc. Seeing no other parties present, the police learn from the drunken man that the woman is behind a closed door in another room. She tells them to leave. They open the door and the woman allegedly assaults one of the officers. The woman was charged with one count of domestic assault and one count of assaulting a police officer, both Class A misdemeanors. Each charge carries a potential maximum penalty of one year in jail and a $2000 fine.
DEFENSE: Attorney Stevens filed a motion to suppress all evidence of the warrantless entry by the police into her house, and the subsequent warrantless entry into the room she was in.
CASE RESULT: The Court granted the motion to suppress evidence of this warrantless entry into the defendant’s home by the police. All evidence in the case was suppressed and both charges were dropped.
